Terms of Service

These Terms are an agreement between you and Dugsiya, Inc. ("Dugsiya", "we", "us"). They cover the Dugsiya app for iPhone and iPad, the teacher dashboard at teacher.dugsiya.com, our website, and the messages we send to parents on behalf of teachers (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use Dugsiya.

1. Who can use Dugsiya

• Adults (18 and over) may create an account and agree to these Terms for themselves.
• Teens aged 13 to 17 may create their own account only if a parent or guardian has read these Terms and agrees to them on the teen's behalf.
• Children under 13 do not create accounts themselves. A parent or guardian creates the child's account in the app, or the child's Quran school creates it as part of enrolment with the parent's permission. The parent or school agrees to these Terms for the child and is responsible for the child's use.
• Teachers and school staff get access to the teacher dashboard after we approve their account. By using it you confirm you are a teacher or administrator at the school you name and that you are authorised to handle its students' information.

You must give us accurate information, keep your sign-in details private, and tell us at support@dugsiya.com if you think someone else has used your account. You are responsible for what happens under your account. One person, one account; a parent may hold several children's accounts under one email.

2. What Dugsiya does

2.1 For students

• Records your recitation of an ayah, transcribes it, grades it, and gives you coaching, by text and by voice.
• An AI coach that talks with you: plays the ayah, listens, tells you what to work on, and moves you on when you are ready.
• Reference recitations by well-known reciters, the Quran text, and translations.
• Progress tracking, streaks, repetition counts, and a leaderboard you can opt out of.
• Assignments from your teacher, if you are in a class.

2.2 For teachers and schools

• Classes and rosters, assignments with due dates, and co-teachers.
• Listening to and grading students' recitations, including reviewing and overriding the AI's grade.
• Attendance, lesson notes, class videos, and messages to parents by text or email.

2.3 About the AI

Dugsiya uses speech recognition and AI models to hear, grade and coach. You acknowledge that:

• Recordings and transcripts are processed by our systems and by the service providers described in the Privacy Policy, some of which are third-party AI services. You consent to that processing when you record.
• Grades and feedback are automated estimates. They are sometimes wrong, especially for very short ayahs, noisy rooms and strong accents. A teacher's judgement overrides Dugsiya's.
• The coach is a learning tool, not a religious authority. It does not issue rulings, and tajweed feedback should be confirmed with a qualified teacher.

2.4 Availability and changes

We work to keep Dugsiya available, but it can be interrupted by maintenance, outages at our providers, or things outside our control, and we do not guarantee uninterrupted access. We improve Dugsiya constantly and may add, change or retire features. If we retire something you paid for, we will tell you and, where appropriate, offer a refund for the unused part of a subscription.

3. Subscriptions and payment

3.1 Free and Premium

• Free: Surah Al-Fatihah with full grading and coaching, plus reading and listening across the Quran.
• Dugsiya Premium: grading and coaching on all 114 surahs and every Premium feature we add. Offered as a monthly or an annual auto-renewing subscription. The exact price is shown in the app before you buy.

3.2 How billing works

• Subscriptions are bought from and billed by Apple through your Apple ID. We never see your payment details.
• Your subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before.
• If we offer a free trial, its length is shown before you start. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription. One trial per Apple ID.
• Prices can change. Apple will notify you before a change applies to you, and you can cancel before it takes effect.

3.3 Cancelling

Open Settings on your iPhone, tap your name, tap Subscriptions, choose Dugsiya, and tap Cancel Subscription. You keep Premium until the end of the period you have paid for, then drop back to Free. Deleting the app or your Dugsiya account does not cancel the subscription; only Apple's Subscriptions page does.

3.4 Refunds

Apple handles refunds under its own policy. Request one at reportaproblem.apple.com. We cannot issue App Store refunds ourselves.

3.5 School, community and promotional codes

A school or community partner may give its students a code that unlocks Premium without a subscription, and we sometimes run promotions. A code is tied to the program that issued it: it can be limited in time or number, it ends when the program ends or you leave the school, it cannot be combined with other offers unless we say so, and it has no cash value. Misusing or reselling codes is a breach of these Terms.

4. Your recordings and content

• You own your recordings. You give us permission to store, process, transcribe, analyse, play back to you and your teacher, and otherwise use them to provide, protect and improve the Service, including through the providers named in the Privacy Policy. That permission ends when you delete the recording or your account, except for de-identified data that no longer identifies you.
• Grades, transcripts and feedback that Dugsiya generates about your recitation are part of the Service. You can see and download the ones about you; we keep the right to use them, de-identified, to improve grading for everyone.
• Only your own voice. Record yourself (or your child, on their account), not other people. Do not upload content that is unlawful, infringing, abusive or not a recitation.
• Teachers' content. Class videos and notes you post must be yours to share, appropriate for the students in the class, and relevant to their learning. You give us permission to host and show them to your class.
• We may remove content that breaks these Terms.

5. Teachers, schools and parents

5.1 Teachers' responsibilities

• Use student information only to teach and administer your class. Keep it confidential. Do not export it, share it, or use it for anything else.
• Only link students you actually teach, and only enter parent contact details the parent has given your school for this purpose.
• Messages to parents are from you. Keep them about the parent's own child. Dugsiya delivers them and keeps a log so you and the parent can see what was sent.
• Keep your dashboard sign-in private. You are responsible for anyone you let use it.

5.2 Schools

A school that enrols students confirms that it has the parents' permission to create the students' accounts and to let Dugsiya process their recitations as the Privacy Policy describes, and that it will obtain each parent's written consent before giving us a phone number for text messages. The school can ask us to remove any of its students' data at any time.

5.3 Parents

A parent or guardian who creates or approves a child's account agrees to these Terms for the child, can see and manage the child's account, and can withdraw consent or delete the account at any time in the app or by email.

6. Text messages to parents (SMS)

Dugsiya offers an optional text messaging program so that a parent or guardian can receive updates about their child's Quran education: progress updates, assignment reminders, attendance notices, and messages from their child's teacher.

• Opt-in: you receive text messages only if you provide your mobile number and consent, in person on a signed consent form at your child's school. See our SMS consent details.
• Message frequency varies. Message and data rates may apply.
• Reply STOP to unsubscribe at any time. Reply HELP for help.
• Consent to receive text messages is not a condition of enrolment or any purchase.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with the subcontractor that delivers the messages is permitted for that purpose only. See our Privacy Policy.

7. Rules of use

Use Dugsiya for learning and teaching Quran. Do not:

• break the law, harass anyone, or impersonate anyone;
• try to get into accounts, data or systems that are not yours, or interfere with the Service;
• copy, scrape, reverse engineer, or build a competing product from the app, its content or its grading;
• use bots or automation against the Service, or manipulate grades or the leaderboard;
• share your account, resell access, or get around a subscription or a code's limits.

If you break these rules we may warn you, suspend you, or close your account, and we may involve the authorities when the law requires.

8. Ownership

• The Quran is not ours. The Arabic text, reference recitations and translations come from Quran.com and the reciters credited in the app, used under their terms. We claim nothing in them.
• Dugsiya is ours. The app, dashboard, design, software, grading methods, coaching and the Dugsiya name and logo belong to Dugsiya, Inc. We license you the app for personal, non-commercial Quran learning (or, for teachers, for teaching your class) on Apple devices you own or control, under Apple's usage rules. That licence is not transferable and can be ended if you break these Terms.
• Ideas you send us about Dugsiya may be used freely, without payment or credit, so that we can keep improving the product without a lawyer in every conversation.

9. Disclaimers

In plain words: we do not promise that the app will always work, that a grade is right, that you will reach a particular level, or that the coach's tajweed feedback is complete. Dugsiya is an educational tool and not a source of religious rulings. Some places do not allow these disclaimers, in which case they apply as far as that law permits.

10. Limits on our liability

These limits are part of the bargain that lets us offer Dugsiya at this price. They do not limit liability that cannot be limited by law, including for our fraud or gross negligence, and nothing here limits a consumer's statutory rights.

11. Your responsibility to us

If someone brings a claim against Dugsiya because of your breach of these Terms, your content, or your misuse of the Service, you agree to cover the resulting costs, including reasonable legal fees. This does not apply to a minor; a parent or school that accepted these Terms for a child is responsible instead.

12. Ending your account

• By you: delete your account in the app under Profile, or email support@dugsiya.com. The Privacy Policy explains what is deleted and when. Remember to cancel any subscription in Apple's Subscriptions page separately.
• By us: we can suspend or close an account that breaks these Terms, where the law requires, or if we stop offering the Service, in which case we will give notice and a refund for any unused prepaid period.
• Sections 4 (your content, as to de-identified data), 8, 9, 10, 11 and 13 continue after an account ends.

13. Disagreements

13.1 Talk to us first

Most problems are fixed by an email to support@dugsiya.com. Before starting arbitration or a claim, write to us and give us 30 days to sort it out.

13.2 Arbitration

If we cannot resolve a dispute informally, you and Dugsiya agree to resolve it by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, before a single arbitrator, in English, by video or in a location convenient to you. Either side may instead bring an eligible claim in small claims court, and either side may ask a court for an injunction to stop infringement of intellectual property or unauthorised access to the Service. The arbitrator's decision is final and can be entered in any court with jurisdiction.

13.3 No class actions

Claims are brought individually. Neither you nor Dugsiya may bring or join a class, collective or representative action, and the arbitrator may not combine one person's claims with another's. If this paragraph is found unenforceable, the whole arbitration agreement is void and the dispute goes to court.

13.4 Opting out

You can opt out of arbitration by emailing support@dugsiya.com within 30 days of first accepting these Terms, with your name, your account email or username, and the words "opt out of arbitration". Opting out does not affect any other part of these Terms.

13.5 Governing law

These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 13.2. If you live in a country whose consumer laws give you rights that cannot be waived, you keep them.

14. If you downloaded the app from Apple

Apple is not a party to these Terms and has no responsibility for the app or its content. In particular:

• Your licence is limited to Apple devices you own or control, under the App Store Terms of Service usage rules.
• Dugsiya, not Apple, is responsible for maintenance and support, for any warranty, for product-liability or regulatory claims, for consumer-protection claims, and for any claim that the app infringes someone's intellectual property. If the app fails to meet a warranty, Apple may refund the price you paid Apple for it and has no further obligation.
• You confirm you are not in a country under a US embargo or designated as supporting terrorism, and are not on a US government list of prohibited parties.
• Apple and its subsidiaries may enforce these Terms against you as third-party beneficiaries.

15. The fine print

• Changes. We may update these Terms. For changes that matter we will give at least 30 days' notice by email and in the app; small clarifications take effect when posted with the date at the top updated. Using Dugsiya after a change takes effect means you accept it; if you do not, delete your account before then.
• Whole agreement. These Terms and the Privacy Policy are the whole agreement between us about Dugsiya.
• If a part fails. If any part is unenforceable, the rest stands.
• Waiver. If we do not enforce something once, we can still enforce it later.
• Transfer. You cannot transfer your account or these Terms. We may transfer them to a successor that takes over Dugsiya, with notice to you.
• Events beyond our control. We are not responsible for delays caused by things like internet failures, provider outages, natural disasters or government action.
• Notices. We will contact you by email or in the app. Contact us at support@dugsiya.com.
• Language. These Terms are written in English; if translated, the English version controls.
