Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Dugsiya Inc. ("Dugsiya," "we," "our," or "us") governing your access to and use of the Dugsiya mobile application (the "App") and any related services (collectively, the "Services").

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

1. Eligibility

1.1 Age Requirement

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1.2 Account Registration

To access certain features of the App, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

1.3 One Account Per User

You may only create and maintain one account. We reserve the right to terminate duplicate accounts.

2. Description of Services

2.1 App Features

Dugsiya is a Quran learning application that provides:

• Audio recording and AI-powered analysis of your Quran recitation
• Personalized feedback on recitation accuracy, pronunciation, and tajweed rules
• Speech-to-text transcription of your recitation
• Text-to-speech audio feedback
• Progress tracking and learning statistics
• Reference audio from renowned Qaris (reciters)
• Leaderboards and social features
• Teacher-student learning relationships
• Learning goals and assignments

2.2 AI-Powered Features

The App uses artificial intelligence to provide its core functionality:

• Speech Recognition: Your voice recordings are processed by our custom AI model (KheemP LoRA) to transcribe your recitation
• Feedback Generation: AI language models (primarily Google Gemini 2.0 Flash, with OpenAI as fallback) analyze your transcription to generate personalized feedback
• Audio Feedback: Text-to-speech technology (ElevenLabs) converts feedback into audio

By using these features, you acknowledge that:

• Your recordings are transmitted to cloud-based AI services
• AI-generated feedback is for educational purposes and may not always be accurate
• AI feedback does not replace instruction from a qualified Quran teacher

2.3 Service Availability

We strive to keep the App available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Updates and improvements
• Third-party service disruptions (AI providers, cloud infrastructure)
• Factors beyond our control

We are not liable for any loss or damage arising from service interruptions.

3. Subscriptions and Payments

3.1 Free and Premium Access

The App offers both free and premium (paid) access:

• Free Access: Limited features, including access to Surah Al-Fatiha (Chapter 1)
• Premium Access ("Dugsiya Pro"): Full access to all 114 surahs, advanced features, and unlimited practice

3.2 Subscription Terms

Premium access is available through subscription plans offered in the App:

• Monthly Subscription: Billed monthly
• Annual Subscription: Billed annually (typically at a discounted rate)

Subscription details:

• Subscriptions are billed in advance on a recurring basis
• Subscription fees are charged to your Apple ID account through the App Store
• All prices are shown in your local currency and include applicable taxes
• Prices may vary by region

3.3 Free Trials

We may offer free trial periods for premium features:

• Trial duration and terms will be clearly disclosed before you start the trial
• At the end of a free trial, your subscription will automatically convert to a paid subscription at the displayed price
• You will be charged unless you cancel at least 24 hours before the trial ends
• Unused portions of a free trial are forfeited when you purchase a subscription
• Free trials are limited to one per Apple ID

3.4 Auto-Renewal

• Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel
• You will be charged the then-current subscription price
• Renewal charges occur within 24 hours before the end of the current period
• To avoid being charged, you must cancel at least 24 hours before the renewal date

3.5 How to Cancel

To cancel your subscription and turn off auto-renewal:

1. Open the Settings app on your iOS device
2. Tap your Apple ID at the top
3. Tap Subscriptions
4. Select Dugsiya
5. Tap Cancel Subscription

Alternatively:

• Open the App Store app
• Tap your profile icon
• Tap Subscriptions
• Select Dugsiya and tap Cancel

Note: Deleting the App does NOT cancel your subscription.

3.6 Effect of Cancellation

Upon cancellation:

• You will retain access to premium features until the end of your current billing period
• Your subscription will not renew
• After the billing period ends, you will be downgraded to free access
• No refunds are provided for partial billing periods

3.7 Payment Failure

If your payment method fails:

• Apple may attempt to charge your payment method again
• Your access to premium features may be suspended until payment is successful
• We are not responsible for any loss of access due to payment failures
• Please ensure your payment information is up to date in your Apple ID settings

3.8 Price Changes

We may change subscription prices at any time:

• Price changes will take effect at the start of your next billing period
• We will provide notice of price changes through the App Store
• If you do not agree to a price change, you may cancel before the change takes effect

3.9 Refunds

All purchases are processed through the Apple App Store:

• Refund requests must be submitted to Apple
• We do not directly process refunds
• Apple's refund policies apply

To request a refund from Apple:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find the Dugsiya purchase
4. Select "Request a refund" and follow the prompts

3.10 Promotional Offers

We may offer promotional pricing, discounts, or special offers:

• Promotional terms will be clearly disclosed
• Promotions may be limited in duration or eligibility
• After a promotional period ends, standard pricing applies
• Promotional offers cannot be combined unless stated otherwise

4. User Content

4.1 Your Recordings

When you use the App to record your Quran recitation ("User Content"):

• You retain ownership of your original recordings
• You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, store, reproduce, analyze, and transmit your recordings to provide and improve the Services
• This license includes the right to process recordings through our AI services and third-party processors
• This license continues for the duration necessary to fulfill our obligations under these Terms and terminates when you delete your recordings or account, except as noted below

4.1.1 Derivative Works and Aggregated Data

You acknowledge and agree that:

• AI Analysis Outputs: Any transcriptions, feedback, accuracy scores, mistake analyses, and other outputs generated by processing your recordings through our AI systems are owned by us and do not constitute your personal data, except to the extent they are directly linked to your account
• Aggregated and De-identified Data: We may create anonymized, aggregated, or de-identified data derived from your usage and recordings (such as statistical patterns, pronunciation trends, and model training insights). Such data does not identify you and is not subject to deletion requests. We own all rights to such aggregated data
• AI Model Improvements: Insights derived from processing recordings may be used to improve our AI models and algorithms. These improvements become our intellectual property. However, your actual voice recordings will not be retained for training purposes after you delete your account
• Service Improvements: Analysis of usage patterns and aggregated performance data may be used to improve the App for all users

4.2 Biometric Data Consent

Your voice recordings constitute biometric data under laws including the Illinois Biometric Information Privacy Act (BIPA):

Separate In-App Consent Required:

• Before any voice recording occurs, you will be presented with a separate biometric consent screen
• This consent screen explains what data is collected, how it is processed, who receives it, and how long it is retained
• You must affirmatively consent through this in-app screen before recording
• This consent is separate from accepting these Terms of Service

Your Consent Rights:

• You may decline biometric consent and still use non-recording features of the App
• You may revoke consent at any time via Settings > Privacy Settings > Voice Recording Consent
• Revoking consent disables future recordings but does not automatically delete existing recordings
• You may request deletion of existing recordings via Settings or by contacting support

4.3 Featured Recordings

If you choose to set a recording as your "featured recording":

• It will be visible to other users who view your profile
• It may appear in community feeds and leaderboards
• You can remove your featured recording at any time
• Setting a featured recording constitutes your consent to share it publicly within the App

4.4 Content Restrictions

You agree not to upload, record, or transmit any content that:

• Is not your own voice or recitation
• Infringes on any third party's rights
• Contains material that is defamatory, obscene, or offensive
• Violates any applicable law or regulation
• Contains malware, viruses, or harmful code
• Is intended to harass, abuse, or harm others

4.5 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

5. Social and Educational Features

5.1 Leaderboards

By using the App, you agree that your progress statistics may be displayed on leaderboards:

• Your username, profile picture, and progress metrics are visible to other users
• Rankings are based on your Dugsiya score and other metrics
• You cannot opt out of leaderboards while maintaining an account
• Contact us if you wish to be excluded from leaderboards

5.2 Friends

You can connect with other users as friends:

• Friend requests require acceptance from both parties
• Friends can see your activity updates and featured recordings
• You can remove friends at any time
• Blocking features may be available for unwanted contact

5.3 Teacher-Student Relationships

The App supports teacher-student learning relationships:

As a Student:

• You may request a teacher or accept teacher requests
• Your teacher can view your progress, assigned goals, and completion status
• Your teacher may be able to listen to recordings you share
• You can terminate the relationship at any time

As a Teacher:

• You may accept student requests
• You can assign learning goals to your students
• You can view student progress and goal completion
• You agree to maintain confidentiality of student information
• You agree not to share student data with third parties
• You can terminate relationships at any time

Consent: By accepting a teacher-student relationship, both parties consent to the data sharing involved. Terminating the relationship revokes data access.

5.4 Community Guidelines

When interacting with other users, you agree to:

• Be respectful and courteous
• Not send spam, unwanted requests, or harassing messages
• Not impersonate others
• Report inappropriate behavior to us
• Follow any additional community guidelines we publish

6. Acceptable Use

6.1 Permitted Use

You may use the App only for its intended purpose: personal Quran learning and practice. You agree to use the App in compliance with all applicable laws and regulations.

6.2 Prohibited Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App, servers, or networks
• Use automated systems (bots, scrapers, crawlers) to access the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright or proprietary notices
• Use the App to harass, abuse, stalk, or harm others
• Impersonate any person, entity, or falsely state your affiliation
• Share your account credentials with others
• Create multiple accounts to circumvent restrictions or bans
• Manipulate leaderboards, scores, or statistics through fraudulent activity
• Attempt to circumvent subscription requirements or payment systems
• Use the App in any manner that could damage our reputation
• Encourage or enable others to violate these Terms

6.3 Enforcement

Violation of these Terms may result in:

• Warning
• Temporary suspension
• Permanent account termination
• Legal action where appropriate

7. Intellectual Property

7.1 Our Intellectual Property

The App and its original content, features, and functionality are owned by Dugsiya Inc. and are protected by international copyright, trademark, and other intellectual property laws.

This includes but is not limited to:

• The Dugsiya name, logo, and branding
• App design, layout, and user interface
• Software code and algorithms
• AI models and feedback systems (excluding third-party components)
• Documentation and marketing materials

7.2 Quran Content

The Quran text displayed in the App is the word of Allah and is not subject to copyright:

• Arabic text is sourced from Quran.com (Uthmani script)
• Audio recitations are from renowned Qaris, sourced with appropriate permissions
• Translations are from various scholars, with attribution provided in the App

• Qaris: Sheikh Abdul Basit Abdul Samad, Sheikh Mishary Rashid Alafasy, Sheikh Saad Al-Ghamdi, Sheikh Muhammad Siddiq Al-Minshawi

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS device(s)
• Use the App for personal, non-commercial Quran learning purposes

This license does NOT include the right to:

• Modify, adapt, or create derivative works of the App
• Use the App for commercial purposes without our written consent
• Sublicense, sell, rent, lease, or distribute the App or its content
• Use our AI systems or APIs independently of the App
• Extract or scrape data from the App

7.4 Feedback

If you provide us with any feedback, suggestions, or ideas about the App:

• You grant us the right to use such feedback without any obligation to you
• We may implement feedback without compensation or attribution
• You waive any claims related to our use of feedback

8. Third-Party Services

8.1 Third-Party Integrations

The App integrates with third-party services:

• Apple App Store: Distribution, payments, subscriptions
• Auth0: User authentication
• RevenueCat: Subscription management
• Google Gemini: AI feedback generation (primary)
• OpenAI: AI feedback generation (fallback)
• ElevenLabs: Text-to-speech
• Quran.com: Quran text and audio
• Sentry: Error monitoring

Your use of these services is subject to their respective terms and privacy policies.

8.2 Third-Party Availability

We are not responsible for the availability or performance of third-party services. If a third-party service is unavailable:

• Certain App features may not function
• We will work to restore functionality as soon as possible
• We are not liable for any resulting loss or inconvenience

8.3 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties.

9. Disclaimer of Warranties

9.1 "As Is" Basis

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 No Warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or reliability of AI-generated feedback
• Warranties that the App will meet your specific requirements
• Warranties regarding third-party services integrated with the App

9.3 Educational Purpose

The App is intended as an educational tool to assist with Quran learning:

• AI-generated feedback should not be considered authoritative religious guidance
• The App does not replace instruction from a qualified Quran teacher (mu'allim/mu'allima)
• We do not guarantee that using the App will result in any particular level of proficiency
• Users should verify their recitation with qualified teachers

9.4 Religious Disclaimer

The App provides educational content related to the Quran:

• We do not provide religious rulings (fatwas) or authoritative religious guidance
• For religious questions, please consult qualified Islamic scholars
• The App is a learning tool, not a religious authority
• Any tajweed feedback is based on AI analysis and should be verified

10. Limitation of Liability

10.1 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DUGSIYA INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, use, goodwill, or other intangible losses
• Any damages resulting from your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on or through the App
• Any unauthorized access, use, or alteration of your content or data
• Any AI-generated feedback that is inaccurate or incomplete
• Any interruption or cessation of the Services
• Any bugs, viruses, or other harmful code transmitted through the App

10.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF:

• The amount you paid us in the twelve (12) months prior to the claim, OR
• One hundred US dollars ($100)

10.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10.4 Basis of the Bargain

THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US. THE APP WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dugsiya Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your violation of any applicable law or regulation
• Any dispute between you and another user

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the App settings, OR
• Contacting us at support@dugsiya.com

Upon account deletion:

• Your personal data will be deleted within 30 days
• Your voice recordings will be permanently deleted
• Your subscription will NOT be automatically cancelled (you must cancel separately)
• Your progress and achievements will be lost

12.2 Termination by Us

We may suspend or terminate your account and access to the App:

• Immediately, without notice, if you violate these Terms
• If we are required to do so by law
• If we discontinue the App or Services
• For any other reason, with reasonable notice

12.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• Your license to use the App is revoked
• We may delete your account and data in accordance with our Privacy Policy
• Outstanding subscription fees remain payable
• Sections of these Terms that should survive termination will survive (including Sections 7, 9, 10, 11, and 13)

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to try to resolve the dispute informally by contacting us at support@dugsiya.com. We will attempt to resolve the dispute within 30 days.

13.2 Arbitration Agreement

You and Dugsiya Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App ("Dispute") shall be resolved through binding arbitration, rather than in court, except that:

• Either party may bring claims in small claims court if eligible
• Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Services

13.3 Arbitration Rules

Arbitration will be conducted:

• By a single arbitrator
• Under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules
• In Delaware, or another mutually agreed location, or virtually
• In the English language

The arbitrator's decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

13.4 Class Action Waiver

YOU AND DUGSIYA INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

The arbitrator may not consolidate more than one person's claims and may not preside over any class, collective, or representative proceeding.

13.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@dugsiya.com within 30 days of first accepting these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out.

13.6 Severability of Arbitration Clause

If the class action waiver is found unenforceable, the entire arbitration agreement shall be void. If any other part of this arbitration agreement is found unenforceable, that part shall be severed and the remainder shall remain in effect.

14. General Provisions

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

14.2 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, representations, and understandings.

14.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

14.5 Assignment

• You may not assign or transfer these Terms or your rights under them without our prior written consent
• We may assign our rights and obligations without restriction
• These Terms will bind and inure to the benefit of the parties' successors and permitted assigns

14.6 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, labor disputes, government actions, internet or infrastructure failures, third-party service outages, or pandemics.

14.7 Notices

• To You: We may provide notices through the App, by email to the address on your account, or by other means
• To Us: You may contact us at the addresses provided in Section 16

14.8 Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.

14.9 Third-Party Beneficiaries

Except as expressly stated (see Section 15), there are no third-party beneficiaries to these Terms.

14.10 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

15. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

15.1 Acknowledgment

• These Terms are between you and Dugsiya Inc. only, not with Apple Inc. ("Apple")
• Apple is not responsible for the App or its content

15.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.

15.3 Maintenance and Support

Dugsiya Inc., not Apple, is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required by law.

15.4 Warranty

• Dugsiya Inc., not Apple, is responsible for any product warranties, whether express or implied by law
• Apple has no warranty obligation with respect to the App
• Any claims relating to the App's failure to conform to any warranty shall be directed to Dugsiya Inc.

15.5 Product Claims

Dugsiya Inc., not Apple, is responsible for addressing any claims relating to the App or your possession and use of the App, including but not limited to:

• Product liability claims
• Claims that the App fails to conform to any legal or regulatory requirement
• Claims arising under consumer protection or similar legislation

15.6 Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Dugsiya Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

15.7 Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

15.8 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15.9 Apple Contact

If you have questions, complaints, or claims regarding the App, contact us at the addresses in Section 16. Apple has no obligation to address such matters.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT:

• You have read and understood these Terms of Service
• You agree to be bound by these Terms
• You are at least 13 years of age
• You understand that voice recording features require separate in-app biometric consent
• You understand the App provides educational tools, not religious authority

These Terms of Service are provided in English. If translated into other languages, the English version shall prevail in case of any discrepancy.
